Terms and Conditions

1. Acceptance of terms

By accessing the website at https://thedarklightfx.com or provisioning a DARKLIGHT FX environment, you agree to be bound by these terms and by all applicable laws and financial regulations, and you agree that you are responsible for compliance with any local regulatory requirements. Where you have signed a separate agreement with us, that agreement takes precedence for the services it covers.

2. Use licence and restrictions

DARKLIGHT FX grants you a non-exclusive licence to use our back-office systems for the products and plan you subscribe to. Under this licence, you may not:

  • Attempt to decompile or reverse engineer any software module contained within the CRM framework.
  • Use the system for unauthorised trading operations or attempt to bypass security or tenant-separation controls.
  • Transfer system access or white-label privileges to unlicensed third-party brokerages.

3. Your responsibilities

DARKLIGHT FX provides technology. Your brokerage remains responsible for its licences and regulatory obligations, its relationships with clients and partners, its MT5 server, payment-provider and KYC-provider accounts, the accuracy of configuration it approves, and the conduct of its staff users.

4. Service availability and performance

While our systems are engineered to run quietly and precisely, DARKLIGHT FX does not guarantee uninterrupted operation during scheduled updates, maintenance, or outages and resets of upstream systems such as trading servers, liquidity bridges, payment providers or KYC providers.

5. Fees

Plan fees are charged monthly as shown on our pricing table or in your proposal. A one-time setup fee for onboarding applies in addition to plan fees.

6. Limitation of liability

To the extent permitted by law, DARKLIGHT FX and its infrastructure providers shall not be liable for operational losses or downtime arising from incorrect API set-ups, unapproved configurations made by your system administrators, or failures of third-party systems outside our control.
